Uncontested / Agreed Divorce

An uncontested (agreed) divorce can be done when both spouses agree to divorce and sign “a divorce settlement agreement.” Getting an uncontested divorce is the most important way to save on the cost of divorce and get a final divorce more quickly.

This agreement that is mentioned must be detailed, comprehensive, consummate and be enforceable by law. In our firm, we give information forms to our clients before preparing the agreement. As a result, we avoid potential contractual conflicts in the future.

In each uncontested divorce, the spouses must agree on all terms and conditions of the divorce in the agreement. Here are some of the main issues that are going to be included in the divorce settlement agreement:

  • Division of marital property and debt
  • Allocation of child custody and parenting time
  • Alimony and any other divorce-related issues relevant to the couple.

Contested Divorce

A contested divorce is where the spouses cannot agree on terms of divorce and must go through the entire divorce process to get a final decision from the court.
Here are some of the grounds for divorce in Turkish Civil Law:

  • Adultery
  • Deliberate attempt to kill, maltreatment or severe humilitaion
  • Committing a crime and unreasonable behavior
  • Desertion
  • Mental disease
  • Irretrievable breakdown of marriage.
